Terms & Conditions Contract
Equipment Rental and Responsibility.
(a) Customer certifies that he or she is either the property owner, has power of attorney for the property owner, or is the licensed contractor/broker for the property. Customer may not sublet the dumpster for any reason.
(b) Price. Customer agrees to rent a Dumpster from Junk Lockdown! LLC, according to the prices and fees set forth at the time of rental. The rental period begins once payment is received and agreement/contract form is signed. The dumpster will be dropped off on the date and time that was specified by the customer, and the dumpster will picked up after the duration the dumpster was rented for is done, unless otherwise granted by the Company.
(c) Weight Limit. Customer agrees to restrict tonnage to "1"(2,000lbs) tons for a Dumpster. If Customer exceeds the relevant tonnage limit, Customer hereby agrees to pay an additional fee of $115 per ton or $54 for half a ton, for each ton in excess of the limit for that dumpster. This price is "NOT"prorated. If Dumpster is kept after the days agreed upon, there will be a $25 per day fee, and dumpster(s) will be subject to additional fees if “dry run” occurs.
(d) Swap-out dumpster rental will be treated exactly as a normal Dumpster rental. A new agreement will be signed with the updated date and time for the drop off and pick up of the new Dumpster, and the “CARD ON FILE” will be charged again for the same amount.
(e) The equipment shall be in the possession and control of the Customer. Customer shall be responsible for the cleanliness and safekeeping of the equipment and is responsible for any, and all damage from the time the equipment is delivered until it is returned. This includes but is not limited to fire, theft, vandalism, negligence, graffiti, natural disaster, or other activity which causes damages. Customer shall pay any taxes (municipal, state, and federal) including personal property taxes, which may be imposed by the possession or use of the equipment. Customer shall not overload the equipment, nor use it for incineration purposes, and shall be liable to for loss or damage in excess of reasonable wear and tear. Customer shall not overload or cause to be overweight, any Dumpster provided by Junk Lockdown! LLC. In the event an overweight fine is sustained by Junk Lockdown! LLC for transporting a Dumpster container loaded by the Customer or its designates, Customer shall incur the cost of any fine and expense
Content Regulations, Loading levels, and weight instructions.
(a) Customer is fully responsible for the entire contents of the container and is the rightful owner of the container’s contents until the container is dumped and the contents are accepted by the prospective disposal facility. The customer is responsible for the filling of the dumpster.
The dumpster must be loaded evenly and level – nothing should extend higher than the side or top trails.

Concrete, bricks, blocks, rocks, tile, pavers, shingles, asphalt, yard waste, and other heavy inert materials (NO DIRT OF ANY KIND ALLOWED), may NOT be loaded any higher than 2 FEET above the bind floor in any size dumpster. Overweight loads are dangerous and are subject to be dumped and reloaded at the customer’s expense. Any heavy material such as Concrete, roofing shingles, etc., is only authorized if previously discussed with Junk Lockdown! LLC and will make a note on customers invoice. If you are unsure if your load is "HEAVY" please ask Junk Lockdown! LLC before loading.
(b) Hazardous and Unacceptable Material Prohibited. Customer warrants and represents that the Dumpster will not contain any hazardous materials and acknowledges that the disposal of such hazardous materials is strictly prohibited. For purposes of this Agreement, “hazardous materials” shall mean any waste which is listed, has the characteristics of, or is otherwise identified as hazardous waste or subject waste under applicable state or federal laws or regulations, including but not limited to the Resource Conservation and Recovery Act of 1976 (42 U.S.C. et seq. and the regulations promulgated thereunder). “Unacceptable material” shall mean any non-hazardous waste which is not permitted to be processed at a facility under applicable laws or permits, source, special nuclear or byproduct material as defined by the Atomic Energy Act of 1954 and the regulations thereunder; asbestos-containing waste; mercury-containing waste; and any waste delivered by Customer which is not approved by Company. Prohibited items also included and not limited to are, flammable liquids, batteries, paint, toxic materials, oils, tires, hazardous waste materials, explosives, pressurized containers of any kind, or any items listed by City, State or Federal agencies with jurisdiction over the respective area. If Customer has any questions about whether a particular material is considered hazardous that was not listed on our “Hazardous and Unacceptable Material Prohibited” list above, please call Junk Lockdown! LLC before disposing of the material in the dumpster, or customer will be subject to extra fees and fines charged to the “card on file” for violating this agreement and hazard disposal laws.

Asbestos or Asbestos Containing Materials (ACM)- applies to both fibrous and solid materials
Closed Compressed Gas Cylinders – high pressure cylinders with valve intact
Combustible or Flammable Materials – fuels, paints, degreasers, unpunctured aerosol cans
Corrosive Materials – highly acidic or caustic materials (battery acid, caustic soda, etc.)
Explosive Materials, Munitions, Shell Casings – includes suspect military scrap
Free Flowing Liquids (including water)
Hazardous Waste – toxic or poisonous materials or wastes
Infectious Materials – blood-soaked or biohazard items
Liquids or Scrap Containing Free Flowing Liquids – fuels, antifreeze, oils, hydraulic fluid, paints (Freon)
Mercury Containing Materials – mercury-containing thermostats, switches or fluorescent light bulbs
Whole tanks uncut
Radioactive Scrap – anything exhibiting radiation levels above background
Chemicals such as cleaning materials
Oils
Electronics:
These items will have an additional cost per item because they need to be disposed off properly and at a separate location then a waste facility. If we incur any fines for those items being disposed of improperly, you the customer will be responsible for those fines for not following the proper disposal guidelines we provided. Junk Lockdown! LLC needs to be notified of these items prior to rental to make sure we have a place to dispose of these items properly.
Electronics list included but not limited to, TV’s(flat screen or tube TV’s) keyboards, Computer monitors, Computer towers, Laptops, fax machines, Printers, Cathode Ray Tubes (CRT/tube-style computer monitors), tablets, cell phones, etc.
Appliances that contain Freon
These items will have an additional cost per item because they are considered “hazardous” and need to be recycled separately and properly. Please keep these items in a separate pile from the rest of the waste(towards the back of the dumpsters near the doors) so we can easily remove them and recycle them at the proper facility.
Refrigerators, Mini fridges, Freezers,
Furnaces, Dehumidifier, Electrical Heaters
Hot Water Heaters, etc.
Tires and Batteries
These items will have an additional cost per item due to faculties extra disposal fees of said items.
Any type of tire 20 inches and under: $15 20 inches or over: $25
Car battery: $10 per battery
Marine battery $40
Smaller batteries (case by case basis)
(c) Required for drop off of the Dumpster. Customer warrants and represents that any location provided by Customer is sufficient to bear the weight of all of Junk Lockdown! LLC’s vehicles, containers, and containers’ contents required to perform the service herein contracted. Junk Lockdown! LLC is not liable for any damage to pavement or other road surface material, lawns, fences, shrubs, septic system, private well, or other property damage. Junk Lockdown! LLC is also not liable for overhead and/or side objects like electrical wire, overhanging roof lines or eaves, trees, walls, corrals, gates, etc., whether these obstructions are on the customer's lot line or on a neighboring property. Junk Lockdown! LLC will make every effort to avoid causing property damage. Junk Lockdown! LLC reserves the right to refuse to place a dumpster if they believe it may cause damage. Customer acknowledges that Junk Lockdown! LLC shall always have access to their Dumpster(s). Let's say that for whatever reason other than the Customer's fault, the driver is unable to instantly access any Dumpster, such as overloaded or banned access. In that situation, the customer is required to pay a $150/hour demurrage fee. Relocations and/or "dry runs" will incur fees starting at $150 and going up per incident. The customer shall defend and hold Junk Lockdown! LLC harmless from all claims, damages suits, penalties, fines, liabilities, and extra costs for any such damage or for extra hauling fees due to the inaccessibility of the Dumpster. Inactive Dumpster(s) may be pulled after seven days at the Contractor’s sole discretion without notice of an extended given contract.
(d) Required for Pickup. Debris may "NOT" extend above the top rim of the dumpster. The tarp"MUST" be able to roll completely over the top "WITHOUT OBSTRUCTION". The end doors "MUST"be "CLOSED" and secured before it can be removed. For purposes of safety, Customer agrees that a 15 cubic yards dumpster shall not be loaded with more than two and a half tons and The customer agrees that a 20 cubic yards dumpster shall not be loaded with more than three tons. Overfilled or unprepared containers will be brought into compliance at Customer’s expense. An effort to Contact customer will be made to bring Debris into compliance. Customer agrees to pay a $150 fee, if customer does not bring dumpster into compliance. The excess Debris that brought the dumpster out of complaince, will be neatly place where dumpster was set for customer to take care of.
(e) Consequences of Violating Regulations. In the event that contents that are not allowed by this contract or any Federal, State, Parish, or City agency are disposed of, all COST, FINES, PENALTIES, or other actions taken for said disposal, the customer is "FULLY" responsible for any and all associated charges. Costs may include but not be limited to cleanup, monitoring, legal fees, penalties, or any other charges associated with unauthorized material disposal. Materials may be returned to the customer at the customer’s expense.
Permits, Approval, and Fees. Customer shall be responsible for obtaining all necessary permits and approvals and paying all fees that may be incurred in conjunction therewith. This includes road/street permits for having dumpsters placed in the public roadway
Indemnification. Customer agrees to indemnify and hold harmless the Company from, against and in respect to any and all claims, lawsuits, losses, expenses, damages, obligations, and any other liability (including costs of collection and reasonable attorney’s fees) for injury to persons or damage to property arising out of the possession or use of the equipment by the Customer. This provision shall survive the termination of agreement.
Entire Agreement. This Agreement contains the entire agreement between the Parties and supersedes all prior agreements and understanding, oral or written, between the Parties with respect to the subject matter hereof. No representation, inducement, promise, understanding, condition or warranty not set forth herein has been made or relied upon by either Party hereto.
Amendment. This Agreement may be modified only by an agreement in writing signed by the Parties hereto.
Governing Law. This Dumpster Rental Agreement shall be construed and enforced in accordance with the laws of the State of Pennsylvania, without regard to the conflicts of law rules of such state.
The parties execute this Agreement and accept and agree to the terms herein and the Dumpster Rental Service Terms & Conditions.
Severability. Customer agrees that each provision contained in this Agreement shall be treated as a separate and independent clause, and the unenforceability of any one clause shall in no way impair the enforceability of any of the other clauses herein. Moreover, if one or more of the provisions or parts thereof contained in this Agreement shall for any reason be held to be excessively broad as to scope, activity or subject so as to be unenforceable at all, such provision or parts or provisions shall be construed by the appropriate judicial body by limiting and reducing it or them, so as to be enforceable to the extent compatible with the then applicable law.
Cancelations. Before 24hr of drop off time, Junk Lockdown! LLC will refund 100% of paid amount to customer. If customer cancels within the 24hr drop off time, Junk Lockdown! LLC will keep $50 of the customers payment and refund the remaining amount. If customer cancels while en route, Junk Lockdown! LLC will keep $100 of customers payment and refund the remaining amount. Customer did not make proper accommodations for Dumpster and cannot be placed at location, Junk Lockdown! LLC will keep $150 of customers payment and refund the remaining amount.
Waiver. A waiver of any claim, demand or right based on the breach of any provision of this Agreement shall not be construed as a waiver of any other claim, demand or right based on a subsequent breach of the same or any other provision.
Credit Card Authorization.
Customer affirms that they are the card holder, owner, or have authorization to use card for purchases of [Services/Goods] through Junk Lockdown LLC.
Customer hereby authorizes [the issuer of the card identified on the invoice/Receipt] Junk Lockdown! LLC to withdraw the amount shown as "DUE/TOTAL/SUBTOTAL" on [Invoice/Receipt]. Customer agrees/promises to pay such "DUE/TOTAL/SUBTOTAL" [together with any other charges due theron] subject to and in accordance with the agreement governing the use of such card. Customer further authorizes Junk Lockdown! LLC to use a third party to process DUE/TOTAL/SUBTOTAL payments, and consent to the disclosure of your payment information to such third party. Customer acknowledges the charge or charges from [Good/Services Receipt] assume full responsibility for said charge or charges.
Card On File. Customer hereby authorize charges to be made on "CARD ON FILE" for outstanding payments, extra fees obtained, or unpaid balances. Customer authorizes Junk Lockdown! LLC to charge the "CARD ON FILE" in there profile in accorance within "Terms & Conditions". The payment authorization is for the [Goods/Services] described on [Invoice/Receipt] for the amount indicated under [DUE/TOTAL/SUBTOTAL] on the [Invoice/Reciept]. Customer is an authorized user for "CARD ON FILE" and acknowledges/Agrees that they WILL NOT DISPUTE the payment with the credit card company so long as the transaction corresponds to the terms & Conditions and Invoice/Receipt.
Sales Tax/Processing Fees. All "DUE/TOTAL/SUBTOTAL" pricing on [Invoice/Reciept] "DOES NOT" include Sales Tax/Processing Fees. "ALL" transactions through Junk Lockdown! LLC website to include but not limited to "DRS/ERS" system [ Processing Agency] will have 3.5% + .15 fee added on all transactions. Customer/Contractor acknowledges Sales Tax/Processing Fees and agrees to pay as set fourth.
Notice. Any notice required or permitted to be given under this Agreement shall be sufficient only if in writing and if sent by United States mail, certified, return receipt requested, postage prepaid, to the Parties at the addresses set forth in the first paragraph of this Agreement.
Signature Acknowledgement. Your "Digital Signature/Signed Signature box/Typed Signature/E-Signing/ S-Signature/Actual Signature" signature verifies/certifies your understanding and acknowledgement of Junk Lockdown! LLC Terms & Conditions Policy.
